By accessing our website and using our landscaping services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, please do not use our services. These terms apply to all visitors, users, and others who wish to access or use our services.

Services

Fairway Rialto Landscaping provides professional landscaping services including lawn care, landscape design, hardscaping, irrigation systems, tree care, mulching, sod installation, and landscape lighting. All services are provided according to the scope of work agreed upon in writing. We reserve the right to refuse service to anyone for any reason at any time.

Service schedules and timelines are estimates and may vary based on weather conditions, material availability, and other factors beyond our control. We will make reasonable efforts to complete work as scheduled.

Pricing and Payment

All prices are subject to change without notice. We will provide you with a written estimate before beginning any work. Payment terms will be specified in your service agreement. We accept various payment methods including cash, check, and major credit cards. Late payments may be subject to additional fees as outlined in your service agreement.

You are responsible for payment of all services rendered, even if you are not satisfied with the results, unless we have failed to meet the specifications outlined in our written agreement. Any disputes regarding billing must be raised within 30 days of the invoice date.

Customer Responsibilities

You are responsible for ensuring that our crew has clear access to the work area. This includes removing obstacles, securing pets, and marking any underground utilities or irrigation lines. You must notify us of any hazards or special conditions on your property before work begins.

You grant us permission to enter your property to perform the agreed-upon services. You are responsible for any damage to our equipment or injury to our staff caused by undisclosed hazards on your property.

Cancellation and Rescheduling

If you need to cancel or reschedule a service appointment, please provide at least 24 hours notice. Cancellations with less than 24 hours notice may be subject to a cancellation fee. For ongoing maintenance contracts, cancellation terms will be specified in your service agreement.

Warranties and Guarantees

We stand behind the quality of our work. Specific warranties for plants, materials, and workmanship will be outlined in your service agreement. Living plants are subject to natural forces beyond our control, and their survival depends on proper care after installation. We will provide you with care instructions for all newly installed plants.

Our liability is limited to the cost of the specific service provided. We are not responsible for indirect or consequential damages. Any warranty claims must be made in writing within the warranty period specified in your service agreement.

Limitation of Liability

Fairway Rialto Landscaping carries appropriate insurance for our business operations. However, we are not liable for damage to underground utilities, irrigation systems, or other hidden hazards that were not marked or disclosed prior to work beginning. We are not responsible for damage caused by severe weather, natural disasters, pests, diseases, or other factors beyond our control.

Intellectual Property

All landscape designs, plans, and creative work produced by Fairway Rialto Landscaping remain our intellectual property until full payment is received. You may not reproduce, distribute, or use our designs for other properties without written permission.

Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
